By-Laws Revision

By-Laws have been revised occasionally since inception, but a full revision has not occurred since 2016. The idea was raised at the April GM, with the purpose of bringing our By-Laws up to date with current expectations and practice relating to conduct of members, and operations and governance of the Co-operative. 

Members were invited to provide comments and suggestions, and none were received. Meanwhile some policy people met to work on the revision and develop a draft for members to consider, and which is below. It’s a work in progress, so members are again invited to consider it and provide any input or ideas, by whatever means suits them.

  1. No 1. Are children of members, regardless of age, or permanency be a guest/visitor or should it read ‘all family’ of members?
    No 3. Visitors/guests, all family, workpeople/tradies/delivery persons. NSW Road Rules – does this include, registered vehicles, licenses, helmets, drug and alcohol consumption? Can police patrol and fine people’s on these roads?

    • Hi Elizabeth,
      No 1. the rule focuses on Children of members only, but this would be a good discussion.
      No 3. NSW road rules apply to all NSW roads but also road related areas open to the public. That is, the law doesn’t differentiate between public and private property when it comes to where the road rules apply. We may be able to get into arguments about private residence but as Goolawah is not gated there is little chance of success. So the answer here is obey the road rules on all of Goolawah roads.

  2. All good simpflications and well put. The last one however may cause some confusion, does it refer to only the point 20, or does it also refer to 21, & 22 as it appears to do in the chart, if so then it’s needing something else to refer to those policies.

    • looks like the suggestion is that 20-23 can be combined. So 20 is the last by-law. (nice round number πŸ™‚ ).

  3. Regarding rule 5.

    “Note: Noise that interferes unreasonably with
    the comfort or rest of others should be
    stopped upon request.”

    This is likely to facilitate the perceived right of a member to be entitled to silence at any time they decide they want a “rest” and they feel it “unreasonable” that they hear anything but the birds.

    This should be removed.

  4. It may be the case that members feel safer to meet and discuss in small groups instead, rather than respond to the comments field on website.Β  Some members may feel that the board can condone or ignore forms of cyber bullying on community social media or target individuals who are critical with ‘rule breaches’. Members are entitled to respond at meetings as well as on website.Β
