Unfortunately the wording of our Rules 34 f and 34h (i) are ambiguous enough that it’s easy to see sense in both Wayne and Denise’s views here, and yes we should make this clearer in the next version. Meantime, for the purpose of this meeting, I think there is one small element of the rules that should sway our choice. Rule 34 h(i) does refer to ‘all nominees’ and then follows that up with ‘with members required to tick seven (7) boxes’. The reference to ‘7 boxes’ here makes it clear that the names of those who nominated early still need to be included in the ballot. So for example, if 4 people nominated early, and then another 4 nominated on the day, all 8 names would need to be on the ballot. If only the 4 nominate-on-the-day names were on the ballot, Rule 34 h (i) would not be satisfied.

    34 h (i). All nominees are to be listed on a ranked choice single ballot paper in alphabetical order, with members required to tick seven (7) boxes.

  2. Hi, perhaps to help clarify the meaning of the Rule which was taken from the model rules in the regulations it might be put a bit differently.

    Firstly rules apply in precedence, unless it is stated otherwise.

    This means,

    If there are insufficient nominees to fill all vacancies, the nominees who applied before the cut off date must to be declared elected at the AGM and further nominations are called from the floor.

    If the new additional nominations the total is seven including the previous nominations all these are declared elected.

    If the new nominations make the number of nominees greater than 7 then a poll is held for the New nominations only.

    This has occurred at a previous AGM.

    It has been pointed out that Rule 34g. is somewhat ambiguous. To clarify:

    If fewer than 7 nominations are received prior to the AGM, nominations for the
    remaining positions shall be called from the floor during the meeting. If, after adding these new nominations;
    i. the total number of nominees equals 7, those nominees shall be declared
    elected at the AGM without the need for a ballot.
    ii. the total number of nominees exceeds 7, a ballot must be conducted to elect the
    seven directors.

    I hope this helps. A rule revision could be consider for the October GM.
