The Legislation requires the cooperative to agree to voting for a group otherwise any vote that follows in respect to voting for directors is Void. The legislation overrides our rules in this case.
I can see that this is to ensure directors are elected democratically. The reason behind this rule is to ensure the community understands the voting system and appreciates that each selected nominees rather than the group may not have at least 50% of the vote.
For example:
If, in our case we require 7 directors and have 11 nominees. Suppose we have 20 members voting and the first 6 directors receive 20 votes each but the remaining 4 receive 6, 5, 5, 4 votes each. As you can see the last 4 nominees did not receive 50% of the vote but the one with 6 would be elected in the group.
The community may see this as unfair and wish to vote individually. As such the first 7 nominees could be voted on individually. When it gets to the 7th member the community would need to vote as a whole for this member. If the community vote more than 50% then the nominee would be elected.
Hi Dan, Directions on the voting paper are to be followed. However, Voting for directors is not preferential, so additional votes are not counted in addition the paper would be void as it does not follow the directions. In regards to counting, the nominees with the most votes are to be elected via the ballot method. For a democratic outcome, then 50% of the community must agree to the group of nominees who are highest ranked, however, should the community choose not to elect the group selected via the ballot papers then each of the highest nominee must be agreed to individually. Although this seems to be excessive, it does give the community the opportunity to agree to each nominee individually and each member must receive more than 50% of the vote. Hope this helps, Wayne
Regarding Valid votes. Is a vote considered valid if more than 7 directors are ticked as a preferred director? My rational for this to be valid. It gives the option, to give a vote to another member. If one(or more) directors chosen is not ranked for a position.
