The Nature Conservation Council and RFS are organising a Hotspots Fire Information Session next Wednesday at the Camp Kitchen, starting at 10 am. Details of the program are in the invitation below – we are all invited to attend.

Special General Meeting – 19 Nov 2022

Notice is hereby given by the Board of a Goolawah Co-operative Special General Meeting to be held at the Camp Kitchen on Saturday19 November 2022 from 9 a.m.

The purpose of the meeting is to consider Special Resolutions for the adoption of Co-operative Capital Units (CCUs), as a means of raising funds for the Nevertire Road upgrade requirements of our recent Land & Environment Court settlement with Kempsey Shire Council.

Below are the Agenda for the meeting with the resolutions and their detailed attachments of the requisite Co-op Rules changes and Terms of Issue for the CCUs, and also a Proxy Form for absentee voting. 

The CCU Disclosure Statement is also a requirement for approval by the Department of Fair Trading, along with the Co-op Annual Financial Statement.

DA Road Funding

Following Court approval of amended conditions for the Co-op DA, the Board has been considering how we could raise the necessary funds to complete sealing of Nevertire Road in the future, and has prepared the document below.

It is a starting point for a bigger conversation with all members, and hopefully an informal meeting can be held soon to share information, discuss and exchange ideas on how to proceed.

DA – Court Judgement

Goolawah Co-operative Limited v Kempsey Shire Council [2022] NSWLEC 1498. 

Further to the DA update at the AGM and recorded in meeting minutes, our lawyer has advised the following. She attended the Land & Environment Court via telephone to take the judgment, which upheld our appeal and granted a new development consent that day.

The judgment has been published, together with the agreed conditions, which constitute the formal granting of consent. We are now free to proceed under that consent, as if it were a consent issued by a Council.

Below are firstly, the Court’s Notice of Orders, together with the approved conditions of consent, and secondly, the complete judgment of Goolawah Co-operative Limited v Kempsey Shire Council [2022] NSWLEC 1498. 

The judgment, together with the conditions, now operate as our DA development consent.
